Minnesota’s wiretapping statute, Section 626A .02, is almost identical to the federal wiretapping statute, 18 U.S.C. Section 2511(1). In general, Minnesota’s statute states that it is legal for a person to record a wire, oral, or electronic communication if that person is a party to the communication, or if one of the parties has consented to the recording, as long as there is no criminal or tortious intent. In other words, you cannot intentionally intercept a communication, nor can you use a communication to commit fraud or blackmail even if you are a party to the conversation and it is not intercepted, unless you get consent.
